1. Agreement to Terms

By accessing or using the SignagePoint platform ("Service"), operated by Quantum Vikings ("Company", "we", "us", or "our"), located at Sønderrad 8, 6780 Skærbæk, Denmark, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you may not use the Service.

2. Description of Service

SignagePoint is a digital signage management platform that enables users to:

  • Upload, manage, and schedule media content (videos, images, websites, and live streams)
  • Deploy content to Android-based signage players, virtual players, and browser-based players
  • Remotely manage and monitor connected signage devices
  • Receive automatic over-the-air software updates on connected devices

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly update your account information if it changes
  • Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these terms or remain inactive for an extended period.

4. Acceptable Use

You agree not to use the Service to:

  • Upload, distribute, or display content that is unlawful, harmful, threatening, defamatory, obscene, or otherwise objectionable
  • Infringe upon the intellectual property rights of any third party
  • Transmit any malware, viruses, or other harmful code
  • Attempt to gain unauthorized access to the Service or its related systems
  • Interfere with or disrupt the Service or servers connected to the Service
  • Use the Service for any purpose that violates applicable local, national, or international law

5. Content Ownership and Responsibility

You retain ownership of all content you upload to the Service. By uploading content, you grant us a limited license to store, process, and deliver your content solely for the purpose of providing the Service.

You are solely responsible for ensuring that any content you upload and display complies with applicable laws, including copyright, trademark, privacy, and advertising regulations.

6. Service Availability

We strive to provide continuous and reliable service. However, we do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to:

  • Scheduled or unscheduled maintenance
  • Server or infrastructure failures
  • Network connectivity issues beyond our control
  • Force majeure events

We will make reasonable efforts to notify users in advance of planned downtime.

7. Device Software

The SignagePoint player application installed on your devices may receive automatic software updates. These updates may include bug fixes, new features, or security patches. By using the Service, you consent to receiving these automatic updates.

8. Fees and Payment

Certain features of the Service may require payment. Pricing, billing terms, and payment methods will be communicated to you at the time of purchase or subscription. All fees are non-refundable unless otherwise stated in writing.

9. Limitation of Liability

To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the total amount you paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless the Company, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these terms.

11. Termination

Either party may terminate the use of the Service at any time. Upon termination:

  • Your access to the Service will be revoked
  • Your uploaded content may be deleted after a reasonable retention period
  • Any outstanding fees remain payable

We reserve the right to terminate or suspend your account immediately, without prior notice, if you breach these terms.

12. Intellectual Property

The Service, including its software, design, logos, and documentation, is the intellectual property of Quantum Vikings and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our prior written consent.

13. Changes to Terms

We may update these Terms and Conditions from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes are posted constitutes acceptance of the revised terms. For significant changes, we will make reasonable efforts to notify active users.

14. Governing Law

These terms are governed by and construed in accordance with the laws of Denmark. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Denmark.
